ESTATE PLANNING AND PROBATE

At Patrick J. Daly we encourage all our clients to make a Will. Making a Will is one of the most important things a person will do.

A will sets out how your entire estate (that is everything you own) will be dealt with upon your death. If no will is made, then you do not decide how your property is dealt with, the law decides.

Making a Will also has serious tax implications in potentially reducing and eliminating the various Tax’s payable.

As well as drafting Wills we at Patrick J. Daly have extensive experience in the Administration of Estates.

Our aim is to work with the executor/Legal Personal Representative to carry out the deceased’s intentions in a timely and effective manner.

LANDLORD AND TENANT LAW

Landlord and Tenant Law revolves around two main areas.

·         Commercial Leasing of Premises.

The aim of the practitioner in Commercial Leasing, whether acting for the Landlord or the Tenant, is to ensure that the Lease accurately reflects the agreement between both the parties.

·         The renting of a private dwelling house

The Residential Tenancies Act, 2004 deals with all issues pertaining to residential leasing. This act established the Private Residential Tenancies Board (PRTB). All disputes concerning a residential lease must be referred to the Board.

At Patrick J. Daly & Co. we have extensive experience in advising both Tenants and Landlords as to their various rights, remedies and obligations in both the above areas.

Consumer Rights

The Sale of Good sand Supply of Services is governed by the Sale of Goods and Supply of Services Act, 1980.

As per the Act, anything that you buy from a purchaser must be

·         Of merchantable quality

·         Fit for its normal purpose and reasonably durable

·         As described, whether the description is part of the advertising or wrapping, on a label, or something said by the salesperson.

A growing area of consumer law is purchasing goods online.

Where goods are purchased online, the purchaser has a seven day “cooling off” period in which to return goods bought online.

At Patrick J. Daly we have built up extensive experience in dealing with consumer rights and protecting the rights of the purchaser.

Feel free to contact us to arrange a no-obligation discussion about the remedies available to you.
